This document provides general instructions for starting a probate case when a person dies without a will. It explains if filing court papers is necessary based on the value and type of assets the deceased person owned.

- Do I need to file court documents?
- You might not need to file court documents if you answered 'No' to questions about real estate and non-real estate assets having a total value over $80,000.00.
- What are the two ways to start a probate case?
- You can start a case either by filing an Application to the Registrar (Informal Proceeding) or by filing a Petition to the Court (Formal Proceeding).
- Is there a fee to file this case?
- A filing fee of $229.00 is required, but if you cannot pay, you must complete the Motion to Waive Fees (JDF 205).
